The median time between filing a patent application and getting an issued patent is around three to four years. However, every patent application is different and the time frame can be shorter or longer depending on the specifics of the invention and the workload of the United States Patent and Trademark Office.

The cost of obtaining a patent can vary. In addition to attorney’s fees for preparing and prosecuting the patent application, there are a variety of fees charged by the Patent Office for everything from filing an application to issue fees and maintenance fees. If you are an individual or a company with less than 500 employees, you can qualify for small entity status. Small entities receive a 50% discount on most Patent Office fees. At some point in the future, the Patent Office will be implementing “micro entity” status, which will reduce the Patent Office fees by 75% for small entities that have filed less than 4 patent applications and have a gross income less than three times the median household income.

Circumstances vary as to whether marks are registerable or not. The timeframe varies for each trademark application depending on various factors. Typically one can expect the process to take as little as nine months to as long as several years.

The cost of filing a trademark application depends on multiple factors. However, the governmental filing fee is $325 for one class of goods with a customized description of goods and/or services. Attorney’s fees for filing a trademark application generally run around $400. Additional costs may incur based on the filing basis of the application and whether or not an application receives an office action from the USPTO.

It does depend on the number of requests for registration pending before the copyright office. However if filed online, most cases register within about a couple of months from the time of filing.
