How Long Does It Take to Get A Patent?
The median time between filing a patent application and getting an issued patent is around three to four years. However, every patent application is different and the time frame can be shorter or longer depending on the specifics of the invention and the workload of the United States Patent and Trademark Office.
How Much Does it Cost to Get a Patent?
The cost of obtaining a patent can vary. In addition to attorney’s fees for preparing and prosecuting the patent application, there are a variety of fees charged by the Patent Office for everything from filing an application to issue fees and maintenance fees. The Patent Office’s current fee schedule can be found here: http://www.uspto.gov/web/offices/ac/qs/ope/fee092611.htm
If you are an individual or a company with less than 500 employees, you can qualify for small entity status. Small entities receive a 50% discount on most Patent Office fees. At some point in the future, the Patent Office will be implementing “micro entity” status, which will reduce the Patent Office fees by 75% for small entities that have filed less than 4 patent applications and have a gross income less than three times the median household income.
